七、乙方义务obligations of party b

八、合同终止及解除的规定termination and dissolution of the contract

（二）有下列情形之一的，本合同终止，甲乙双方互不承担违约责任：
1、该房屋因城市建设需要被依法列入房屋拆迁范围的。
2、因地震、火灾等不可抗力致使房屋毁损、灭失或造成其他损失的。
（三）甲方有下列情形之一的，乙方有权单方解除合同且甲方退还保证金：
1、不承担约定的维修义务致使乙方无法正常使用该房屋的。
2、交付的房屋危及乙方安全或者健康的。
（四）乙方有下列情形之一的，甲方有权单方解除合同，收回该房屋且保证金不退：
1、不支付或者不按照约定支付租金达_____日的。
2、利用该房屋从事违法活动的。
3、利用该房屋存放大量危险品（如：有毒化学工业产品、易燃易爆产品、具有挥发刺激性气味产品、具有挥发有毒性气味产品等）。
4、被其他业主投诉乙方行为影响其作息生活，查明属实，且警告不予改正的。
第十条合同争议的解决办法
本合同项下发生的争议，由双方当事人协商解决或申请调解解决；协商或调解不成的，依法向人民法院起诉，或按照另行达成的仲裁条款或仲裁协议申请仲裁。
本合同经甲乙双方签字盖章后生效。本合同（及附件）一式______份，其中甲方执______份，乙方执______份。

第一条、本停车位位置及面积
本停车位位于常德市朝阳路紫河湾小区(以下简称本小区) xxx位号码以开发商排序为准)。

第三条、本停车位的租赁费及物业管理费
1、车位租赁费
(1)金额

(2)交付期限及方式

2、物业管理

第四条、本停车位的使用
1、乙方不得更改本停车位用途。乙方使用本停车位应当遵守本小区物业管理单位对本停车场的相关规定，该等规定乙方有义务自行了解。
2、乙方已考察本停车位，乙方保证所停车辆不超过车位空间限额的长、宽、高，以及停车场地面承受压力要求，停放车辆的水平投影面积小于本停车位面积，并保证不妨碍相邻车位的使用，以符合停车位的要求。
3、乙方停放的车辆内不得有人、生物留置。乙方车辆不得外附或内装任何危险物品，包括易燃、易爆、腐蚀性、毒害性、放射性等违反国家规定的物品，不得存放任何易腐烂性物品。因此产生的一切责任由乙方承担。本小区物业管理单位有权对认为可疑的车辆进行检查，乙方应当协助检查，不得阻挠。
4、未经甲方同意，乙方不得将本停车位转租、转借任何第三人使用。否则，甲方有权解除合同。
5、乙方应当按物业管理单位规定的进出时间使用车位，乙方车辆在进入停车场后应当立即停放于本停车位，不得造成道路或通道堵塞。
6、乙方离开车辆时应尽到包括锁好防盗锁、关闭电路、锁好门窗等谨慎检查义务;车内物品丢失责任，与甲方无关;但乙方向物业管理公司索赔，甲方应证实乙方为车位合法租赁方。
7、乙方不得在停车场内乱扔废弃物，有义务对因油品泄露、强酸强碱等原因导致车位污损进行清洁、维修;乙方不得将漏油车辆开进停车场。
第五条、双方责任
1、乙方在停车场内所受损失，乙方应当自行向造成损害的他方索赔。
2、乙方停车位的使用及其车辆进出停车场、停车位或其停放，不得损害其他人的合法权益。因乙方原因造成他方损害，乙方应当赔偿。
第六条、保险
乙方应当为在本停车位停放的车辆，自行投保包括车辆盗抢险等保险。甲方无义务对本停车位及地上停放车辆投保。

根据《中华人民共和国合同法》及交通部相关规章，为明确出租方（甲方）与承租方（乙方）权利义务关系。经双方协商一致，签订汽车租赁合同，设定下列条款，共同遵守。
第一条、租车期限

第二条：租金及交付期限

2．甲方负责对租赁车辆投保车辆损失险、第三者责任、交强险及不计免赔险。
3．甲方有按时收取租金的权利。
4．乙方不按约定支付租金，甲方有权收回租赁车辆。
5．对因非甲方原因造成的损失，甲方不负连带责任。
第四条：乙方权利、义务
1．乙方提供给甲方的资料应保证真实有效（如身份证、户口簿、驾驶证、单位营业执照副本等）否则就此产生的责任均由乙方负责。
2．乙方认真检查并掌握租赁车辆的各种性能和操作方法，点清车辆附件，验收签字后驶离。凡因乙方操作不当，保管不善造成车辆遗失或造成附件损坏，乙方应向甲方赔偿。因车辆自然折旧耗损造成的损失和故障，以及因车辆本身质量、缺陷、不足等原因发生的损失和故障，由甲方承担责任。
3．本车使用93号汽油，因未使用指定汽油造成的车辆损失等后果由甲方承担。
4．乙方负责在车辆保修期内对车辆进行免费定期保养、正常保修和年检，甲方予以协助。（需承担4S店根据汽车年限和公里数制定的保养计划（包括空气滤芯、汽油滤芯、空调滤芯器、助力转向油、刹车油、变速箱油、火花塞，轮胎）
5．租赁期间，应遵守国家有关法律、法规、法令，安全行车，因违法、违纪、违章所造成的法律责任，自行负责，并承担行驶过程中因自身驾驶责任造成车辆的经济损失。
6．如在租赁期间因违章驾驶（如超速驾驶、不按规定路线行驶、冲红灯等被电子眼监控摄录）而被罚款或责令承担其他责任，乙方须承担后续责任。
7．租赁车辆，不得将车辆转租、出售、典当、抵押、担保或其他超出本合同的其他权利。不能私自拆装甲方的车体（件）（车辆以交付时为原状），否则甲方有权收回车辆并要求乙方赔偿所造成的损失。
8．如发生交通事故，承担公安交通管理部门裁定的责任，并承担车辆维修费用和修理期间车辆的租金（每天 元人民币）。对因乙方原因造成的损失甲方不负连带责任。
9．租赁车辆使用期间，发生交通事故，应及时向当地公安交通、保险部门报案联系，通知甲方协助解决。如肇事后逃逸或驾离现场，乙方应承担所有违法、违章、赔偿责任。
10. 租赁期内或租赁期满时，双方须共同检查租赁车辆的各种性能，点清车辆附件，验收签字后，合同终止。凡因乙方操作不当，保管不善，造成车辆损失（如划花车身）或造成附件损坏，乙方应恢复原状，不能恢复原状赔偿甲方损失，因碰撞导致的事故车辆加速折旧费用由乙方承担。
11. 甲方要保护好乙方车辆上的特征标志，不得涂改遗失，严禁私自拆、换车辆上的任何部件及设备，严禁拆动里程表
12. 租赁期间，因乙方过错行为导致汽车被盗或被抢或发生自然燃烧，乙方应承担保险公司赔付不足分和车辆理赔期间的租金损失。
13. 租赁的车辆不能装载易燃、易爆、易腐蚀物品或其他违禁物品。
14. 乙方不能利用租赁车辆从事违法活动；进行体育、军事、竞赛和作测试使用。
第五条、车辆行驶里程范围
双方约定，租赁车辆在租赁期间限定每月行驶里程里程为 公里，超里程加付0.8 元/公里 。
第六条、期满时的处理、续租
1. 乙方要求延长租赁期，应在租期满前24小时通知甲方，双方共同协商重新达成协议。
2. 不缔结新的合同时，租赁期满后本合同圆满结束。如因乙方原因继续使用，而不签订租赁合同，甲方有权收回车辆。
第七条、合同变更及附近补充
本合同相关条款的变更或删除需经双方书面确认，并达成补充协议。
第八条、违约责任
1. 合同期满后，乙方未办理延期手续，也未按时归还甲方车辆的，给甲方造成经济损失的，乙方要予以赔偿。
2. 在合同期内因乙方原因提前终止合同，乙方须首先付清实际租赁期间的租金并赔偿甲方未履行部分总租金20%的费用。
3. 甲方应严格按照本合同履行其义务，由于甲方未能完善履行其义务而造成的损失，均由甲方自行承担，并赔偿乙方未履行部分总租金20%的费用。
第九条、不可抗力
1. 甲方或乙方因不可抗力部分或全部迟延或不能履行其在合同项下义务的，不承担违约责任，但应立即与对方协商解决办法，并及时采取措施减少因不可抗力造成的损失。
2. 合同所指不可抗力，是指合同签订后发生的、不能预见、不能避免并且不能克服的客观情况；其中包括政府政策改变等乙方不可控制因素等。
第十条、法律适用和争议解决
本合同的订立、履行、解释及争议的解决均适用中华人民共和国法律，甲乙双方如因合同订立、履行或解释发生任何争议应协商解决。若协商不成，可合同签订地的人民法院提出诉讼。
第十一条、额外设备的装配
乙方要求额外装配本合同外的零配件和设备时，必须在征得甲方的同意下进行，所需费用由乙方承担，其所有权须经甲方书面同意，否则属甲方所有。
第十二条、合同生效及附件
1. 本合同自双方签字（盖章）且乙方交纳押金，甲方交付车辆起正式生效。
2. 本合同共两页一式两份。甲方持正本一份，乙方一份。附件为本合同的组成部分。
本合同未尽事宜，按国家有关法规执行。
